1. Agreement and Platform Role
1.1 Agreement Formation These Terms and Conditions (“Terms”) form a binding legal agreement between you (“User”) and Troja.al (“Platform,” “we,” “us,” or “our”) governing your use of the Troja.al website and services. By accessing or using our platform, you accept these Terms in full.
1.2 Platform Role Definition Troja.al operates exclusively as an online marketplace platform connecting property buyers, sellers, and renters. We are not a real estate agent, broker, or property owner. We do not:
- Own, sell, rent, or lease any properties listed on our platform
- Participate in negotiations between users
- Provide property advice, valuations, or recommendations
- Handle property transactions or payments between users
- Verify property information, ownership, or legal status
- Act as agent for buyers, sellers, or renters
1.3 Intermediary Status We function solely as a technology intermediary facilitating connections between users. All property transactions, communications, negotiations, and agreements occur exclusively between users without our involvement, participation, or endorsement.
2. User Responsibilities and Warranties
2.1 Account Registration and Accuracy Users must provide accurate, current, and complete information during registration. You are solely responsible for maintaining account security and all activities under your account. You warrant that all information provided is truthful and you have authority to enter into these Terms.
2.2 Property Listing Obligations Users posting property listings warrant that they: Have legal authority to list the property
- Own the property or have explicit owner authorization
- Provide accurate property descriptions, photos, and pricing
- Comply with all applicable housing, zoning, and advertising laws
- Will not post discriminatory, fraudulent, or misleading content
- Hold valid legal title or rental authority
2.3 Due Diligence Responsibility Users are solely responsible for conducting their own due diligence regarding any property transaction, including but not limited to:
- Property condition and legal status verification
- Title searches and ownership confirmation
- Zoning compliance and permitted uses
- Property inspections and evaluations
- Legal compliance and regulatory requirements
- Tax obligations and transfer procedures
- Insurance and financing arrangements
2.4 Content Standards All user-generated content must comply with our Community Guidelines and applicable laws. Users may not post content that is illegal, fraudulent, discriminatory, defamatory, or infringes intellectual property rights.
3. Liability Limitations and Disclaimers
3.1 Service Provision Disclaimer THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. We make no representations regarding:
- Property information accuracy or completeness
- User identity verification or trustworthiness
- Transaction success or legal validity
- Platform availability or technical performance
- Content accuracy or reliability
3.2 Liability Limitations TO THE MAXIMUM EXTENT PERMITTED BY LAW:
For Consumer Users: Our total liability for any claims arising from platform use is limited to the greater of: (a) fees paid to us in the 12 months preceding the claim, or (b) £500.
For Business Users: Our total liability is limited to fees paid to us in the 3 months preceding the claim.
3.3 Excluded Damages We exclude all liability for:
- Indirect, consequential, punitive, or exemplary damages
- Loss of profits, business opportunities, or goodwill
- Property transaction failures or disputes
- User misconduct or fraudulent activities
- Third-party actions or omissions
- Data loss or system interruptions
3.4 Essential Exceptions Nothing in these Terms excludes our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation by us
- Breach of statutory consumer rights that cannot be legally excluded
- Any other liability that cannot be legally limited or excluded
4. User Indemnification
4.1 Indemnification Obligation You agree to indemnify, defend, and hold harmless Troja.al, its officers, directors, employees, and agents from all claims, damages, losses, and expenses (including legal fees) arising from:
- Your use of the platform or services
- Content you post or transmit through the platform
- Property transactions or disputes with other users
- Your breach of these Terms or applicable laws
- Infringement of third-party rights through your activities
- Your provision of false or misleading information
4.2 Defense Cooperation We reserve the right to assume exclusive defense of any matter subject to indemnification, with your cooperation in the defense as reasonably requested.
5. Content and Intellectual Property
5.1 User Content License By posting content on our platform, you grant us a non-exclusive, worldwide, royalty-free license to use, display, distribute, and modify your content for platform operation, marketing, and service improvement purposes.
5.2 Intellectual Property Protection We respect intellectual property rights and maintain procedures for addressing infringement claims. Users may not post content that infringes copyrights, trademarks, or other intellectual property rights.
5.3 Copyright Compliance We comply with the Digital Millennium Copyright Act and similar international frameworks. Copyright holders may submit takedown notices to our designated agent. We maintain policies for terminating repeat infringers’ accounts.
5.4 Platform Content Rights All platform design, software, features, and proprietary content remain our intellectual property. Users receive only limited licenses for platform use as expressly granted in these Terms.
6.Payment Processing and Premium Features
6.1 Payment Processing Payment processing for premium features is handled exclusively by our licensed payment processor (Stripe). We do not store payment information or handle financial transactions directly. You must comply with the payment processor’s terms of service.
6.2 Premium Features Premium features (boosted listings, analytics) are provided subject to additional terms and fees. No refunds are provided for premium features except as required by applicable consumer protection laws.
6.3 Transaction Fees We do not charge commissions on property transactions between users. Users are responsible for any direct negotiations regarding fees, commissions, or transaction costs.
7.Privacy and Data Protection
7.1 Data Processing We process personal data in accordance with our Privacy Policy and applicable data protection laws, including GDPR and UK data protection legislation. Our lawful basis for processing includes legitimate interests for platform operation and consent for marketing communications.

7.3 International Data Transfers Personal data may be transferred internationally for platform operation, always with appropriate safeguards as required by applicable data protection laws.

8. Content Moderation and Platform Policies
8.1 Content Review We reserve the right to review, moderate, and remove content that violates these Terms or applicable laws, but we are not obligated to monitor, review, or approve content before publication.
8.2 Takedown Procedures Users may report inappropriate content through our reporting mechanisms. We will investigate reports and take appropriate action, which may include content removal or account suspension.
8.3 Account Termination We may suspend or terminate accounts for violations of these Terms, illegal activities, or at our discretion with reasonable notice. Users may terminate accounts at any time through account settings.
9. Dispute Resolution
9.1 Internal Resolution Users should first attempt to resolve disputes through our customer service at [email protected]. We will make reasonable efforts to facilitate resolution within 30 days.
9.2 Alternative Dispute Resolution For disputes not resolved internally, we provide access to online dispute resolution services. Consumer users may also access applicable ombudsman schemes or small claims courts.
9.3 Binding Arbitration (Business Users Only) Business users agree that disputes will be resolved through binding arbitration rather than courts, except for small claims actions. Arbitration will be conducted under established arbitration rules in the jurisdiction of our incorporation.
9.4 Class Action Waiver Business users waive rights to participate in class actions, collective proceedings, or representative actions. Each party may only pursue individual claims.
10. Governing Law and Jurisdiction
10.1 Governing Law
- Consumer Users: These Terms are governed by the laws of your country of residence for consumer protection matters, with English law applying to commercial aspects.
- Business Users: These Terms are governed by English law.
10.2 Jurisdiction
- Consumer Users: Disputes may be brought in courts of your country of residence or English courts at your choice.
- Business Users: Disputes are subject to exclusive jurisdiction of English courts, except for arbitration proceedings.
10.3 EU/EEA Users EU and EEA users benefit from consumer protection laws in their country of residence. Nothing in these Terms reduces those statutory protections.
11.Platform Availability and Technical Issues
11.1 Service Availability We strive to maintain platform availability but do not guarantee uninterrupted service. We may suspend services for maintenance, updates, or technical issues with reasonable notice when possible.
11.2 Technical Support Technical support is provided on a reasonable efforts basis through [email protected]. We do not guarantee specific response times or resolution outcomes.
11.3 System Requirements Users are responsible for maintaining compatible devices, internet connections, and software necessary for platform access.
12. Force Majeure
12.1 Force Majeure Events We are not liable for performance delays or failures due to events beyond our reasonable control, including natural disasters, government actions, technical failures, cyberattacks, or other unforeseeable circumstances.
12.2 Notification and Mitigation We will provide reasonable notice of force majeure events affecting service availability and make reasonable efforts to minimize disruption.
13. Compliance and Regulatory Matters
13.1 Anti-Money Laundering Users must comply with applicable anti-money laundering and financial crime prevention laws. We reserve the right to request additional documentation for verification purposes.
13.2 Sanctions Compliance Users may not use the platform for transactions involving sanctioned individuals, entities, or jurisdictions. We maintain screening procedures to ensure sanctions compliance.
13.3 Tax Obligations Users are solely responsible for determining and fulfilling their tax obligations related to property transactions and platform use.
14. Accessibility and Language
14.1 Accessibility Standards We strive to maintain accessibility standards (WCAG 2.1 AA) to ensure platform usability for users with disabilities. Contact us to report accessibility issues or request accommodations.
14.2 Language Versions These Terms are available in English and Albanian. In case of conflicts
between language versions, the English version prevails except where local law requires otherwise for consumer contracts.
15.Terms Updates and Communication
15.1 Terms Modifications We may update these Terms with reasonable notice. Continued platform use after changes indicates acceptance. Material changes affecting consumer rights will be prominently notified.

15.3 Severability If any provision of these Terms is found unenforceable, the remaining provisions continue in full effect. Unenforceable provisions will be modified to reflect our original intent to the maximum extent possible.
